Welcome to Artwist (the “Site”). These Terms & Conditions (the “Terms”) govern your access to and use of the Site, our design tools (including AI-assisted features), and the purchase of customized products and ready‑made designs (collectively, the “Services”).
By using the Services, you agree to be bound by these Terms and our Privacy Policy and Return Policy (together, the “Policies”). If you do not agree, please do not use the Services.

1) Who We Are
Artwist is a Lebanese startup specializing in custom printing, technology, web development, and AI. We operate online and from our retail branch in *Le Mall Dbayeh, Lebanon. Our production facility and primary business address is **92 Adma, Orange Zone, Adma W Dafneh, Keserwan, Lebanon*. “Artwist,” “we,” “us,” and “our” refer to the entity operating the Services.

2) Eligibility & Accounts
• You must be at least 18 years old (or have parental/guardian consent) to place orders.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You agree to provide accurate, current, and complete information and to keep it updated.

3) Products, Personalization & Proofs
• *Print‑on‑demand:* Most items are custom‑made to your order using your uploaded content and/or our ready‑made designs and templates.
• *Design tools:* You may upload your own artwork or use our editors and AI‑assisted features to generate/adjust designs. AI outputs may contain imperfections; you are responsible for reviewing and approving your design before ordering.
• *Previews & colors:* On‑screen previews are approximate. Colors and placement can vary slightly due to monitor settings, fabric/material characteristics, and print methods.
• *Sizing & materials:* Check size charts and product descriptions carefully. Minor tolerances in measurements and materials are normal for textile and sublimation/print processes.
• *Order review:* Please double‑check spelling, names, dates, and layout before checkout. We may contact you if we detect obvious issues but cannot guarantee detection.

4) Order Acceptance, Cancellations & Changes
• Your order is an offer to buy. We may accept or decline any order (e.g., due to suspected infringement, prohibited content, pricing/stock errors, or inability to fulfill).
• *Production starts quickly.* Changes/cancellations may be possible *only before* printing begins. Once production has started, changes/cancellations are not guaranteed and may incur costs. Contact us immediately if you need help.

5) Pricing, Currency, Taxes & Duties
• Prices on the Site are generally shown in *USD ($)* unless stated otherwise. Charges in other currencies may be converted by your payment provider at its rates and fees.
• Taxes, shipping, and any applicable duties or customs fees are *additional* and shown at checkout where possible. For international deliveries, you are responsible for duties, import taxes, and clearance.
• We reserve the right to change prices, promotions, and product availability at any time. Obvious pricing mistakes are not binding and may result in order cancellation with a refund.

6) Shipping & Delivery
• *Lebanon:* Typical delivery time is *2–5 days* after order confirmation (business days, excluding holidays; times may vary by location and carrier).
• *International:* We ship worldwide. Delivery times and fees vary by destination, carrier capacity, and customs processing.
• *Address accuracy:* You are responsible for providing a complete and accurate shipping address. Re‑shipments due to incorrect/insufficient addresses may incur additional fees.
• *Risk of loss:* Title and risk of loss pass to you upon delivery to the address provided. For carrier‑confirmed deliveries, claims for loss/damage must be submitted promptly with photographs and order details.
• Delays caused by customs, weather, force majeure, or carrier issues are outside our reasonable control and are not grounds for cancellation.

7) Quality Guarantee, Returns & Refunds (Summary)
• We stand behind the *high quality of materials and finishing. Because items are **customized, we **do not accept returns* for change of mind, wrong size chosen, or user design errors.
• If your item arrives *defective* or with *printing/production faults* or significant damage in transit, notify us *within 7 days of delivery* with clear photos/videos and your order number. After review, we will, at our discretion, *reprint/replace* the item or *issue a refund*.
• Natural variations in color, small alignment tolerances, and minor differences from on‑screen previews are expected and not considered defects.
• Full details are provided in our *Return Policy* (incorporated by reference).

8) Your Content & License to Us
• You represent and warrant that you *own or have all necessary rights* to any text, images, logos, photographs, artwork, and other content you upload or request us to print (“User Content”).
• You grant Artwist a *non‑exclusive, worldwide, royalty‑free license* to use, reproduce, modify (for technical production needs), and print User Content *solely to fulfill your orders* and provide the Services. Where you give explicit consent, we may also feature your finished items in our galleries, social channels, ads, or samples.
• You are solely responsible for User Content, including obtaining permissions for third‑party intellectual property (e.g., brand logos, characters, photos of people). We may reject or remove any order/User Content that we believe violates these Terms or applicable law.

9) Acceptable Use & Prohibited Content
You agree not to upload or request printing of content that is: (a) illegal, infringing, or deceptive; (b) hateful, harassing, or discriminatory; (c) sexually explicit or pornographic; (d) violent or promoting harm; (e) defamatory or violating privacy/publicity rights; (f) containing third‑party IP without permission; or (g) otherwise inconsistent with our values or applicable laws. We may cancel orders that violate this section and, where required, report unlawful content.

10) Ownership of Site Content & Designs
All content on the Site (including text, graphics, UI, software, templates, and ready‑made designs) is owned by Artwist or its licensors and is protected by IP laws. Except as expressly permitted for personal use of purchased items, you may not copy, distribute, or create derivative works from our content without prior written consent.

11) AI‑Assisted Features
Our AI tools can help generate or enhance designs, upscale images, or suggest edits. *You remain the designer of record* and are responsible for reviewing outputs and ensuring compliance with these Terms and applicable laws. AI outputs are provided on an *“as is”* basis and may resemble content generated for others due to model limitations. We do not guarantee exclusivity or originality of AI outputs. Use of AI features may involve processing your prompts and uploaded content to provide and improve the Services; see our Privacy Policy for details.

12) Warranties & Disclaimers
Except for the quality commitment described above, the Services and all items are provided *“as is”* and *“as available”* without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. Some jurisdictions do not allow disclaimers of implied warranties, so some disclaimers may not apply to you.

13) Limitation of Liability
To the maximum extent permitted by law, Artwist and its officers, employees, and partners shall not be liable for (a) indirect, incidental, special, consequential, or punitive damages; (b) loss of profits, revenue, data, or goodwill; or (c) aggregate liability exceeding the amount you paid for the order giving rise to the claim. Nothing in these Terms limits liability for gross negligence, willful misconduct, or injury where such limitation is prohibited by law.

14) Indemnification
You agree to indemnify and hold harmless Artwist from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your User Content; (b) your breach of these Terms; or (c) your violation of any law or third‑party rights.

15) Changes to the Services or Terms
We may update the Services and these Terms from time to time. Changes take effect upon posting on the Site with an updated effective date. Material changes will be reasonably notified. Your continued use after changes constitutes acceptance.

16) Governing Law & Dispute Resolution
These Terms and any dispute or claim (contractual or non‑contractual) arising out of or related to them are governed by the laws of *Lebanon. You and Artwist agree to the exclusive jurisdiction of the **courts of Beirut, Lebanon*. If a court finds any provision unenforceable, the remaining provisions remain in full force.

18) Miscellaneous
• *Entire Agreement.* These Terms and the Policies constitute the entire agreement between you and Artwist regarding the Services.
• *No waiver.* Failure to enforce any provision is not a waiver.
• *Assignment.* You may not assign your rights without our consent; we may assign as part of a merger, acquisition, or asset transfer.
• *Language.* We may publish translations for convenience. The English version controls in case of conflict.
